Selling on Handango and PocketGear

I have noticed that these sites both sell many of the same products. These two sites also contain exclusivity clauses in their developer agreements that state they must be the exclusive point sale.

How is that so many applications get around this including some apps by people here?

Don't know if this is really the place to ask this question but I noticed that some GE developers here list their products on both sites. Feel free to PM me or email me.

I was also wondering about this a few months ago and so i sent Handango an email, this is their reply
No, the agreement is not exclusive. You’re still free to sell your software through other distributors.

As i remember you have to make a diferent version of your game for each distributor in wich they are regarded as the only point of sale, otherwise you are free to send your game to as many distributors as you like.

Ah, that’s great news :) I was reading through pocketgears agreement and was slightly put off by the exclusive part as I really want to release to a wide range of sites. Creating a different version with different splash screens or text is no problem :)

I’ve not made a final decision on the price at the moment, but it’s likely to be $9.99. I’m also planning to release new ‘chapters’ for the game, these are add-on packs that can be downloaded that add levels to the non-story modes already available in the game, these will be free and once downloaded will be playable through the main game only. I don’t see the game itself as the whole picture, to make it successful continued support and development will be needed. I’ll also be listening carefully to what the customers say :)

Hey peeps,

I sell (or attempt to sell :? ) a couple of pieces of software on Handango, PocketGear, and Clickgamer. Don't detrimentally rely on this or anything, but I'm pretty sure that if you read the agreements closely, you'll see that each distributor requires only that if you make a demo version of the game available, you direct the user to purchase the software at the place where they got the demo version.

So, for example, with Quest of the Styli (the game I just released) I have two versions of the software. They are identical to each other except that one of them, when it starts and exits, says "purchase the full version at Handango" and the other says "purchase the full version at Clickgamer."

Also, note that if you don't have a demo available, none of this applies (i.e., you don't have to mention that you got the full version at whatever site). As a side note, I've become disenchanted with PocketGear and so am no longer going to distribute my stuff through them.
