Actually the law does not say that you may use them in a demo/non-commercial game, quite the opposite in fact. Just because its available doesn't make it legal, and just because not everyone that uses them will get sued doesn't make it right. Specifically, if you are going to use them only to learn, but not upload it anywhere (distribute, free or otherwise), its fine. But as soon as you upload it for others to download and play you've broken the law. If you want to do that, you'll need to contact the copyright holder and ask permission. And I am not some inexperienced kid, I worked for EIDOS for ten years in the game industry and do know a thing or two about how it works. Cheers.
